1. Services and agreement
杭州通微人工智能科技有限公司 (Sagaway, “we”) provides LabMind mobile apps, the labmind.sagaway.cn console and associated research and work services. Read these terms, the Privacy Policy and relevant feature descriptions before registering or using account-based services. If you act for an institution, you must have authority to grant the relevant permissions; personal use does not automatically bind your institution.
Services include available AI conversations and tasks, files and cloud storage, computer or cloud execution, and related research features. Features, models, regional eligibility and allowances depend on the version, account and interface descriptions. A separate institutional agreement governs matters expressly covered by it. These terms do not exclude statutory consumer rights.
Minors should use the service with their guardian’s knowledge and consent and meet local age and authorization requirements. The service is not designed for children.
2. Accounts and security
- Provide accurate, reachable account information and maintain access to your mobile number or other authentication method. Do not impersonate others or bypass verification. Sign-in and SMS availability depend on the supported authentication method.
- Protect credentials, verification codes, devices and authorizations. Do not share access with unauthorized people. Revoke affected device access and contact us if you notice an unusual sign-in.
- Institution administrators and collaborators have only the permissions granted to them. Check visibility before joining shared spaces. Personal account access is not authorization to access every institutional file or resource.
- Manage your profile, devices and content through available controls. Contact privacy@sagaway.ai for privacy or account closure requests. Stopping use or uninstalling the app does not automatically delete the server account.
3. AI output and professional judgment
AI may produce incorrect, incomplete, outdated or plausible but nonexistent information, including references, calculations, code and conclusions. Output is not medical, legal, investment, safety or other professional advice and does not replace experimental verification, peer review or qualified judgment.
Review output and sources, verify important facts, calculations and code, and follow academic integrity, attribution and citation requirements. You are responsible for decisions you make based on output. Do not use unverified output for decisions that could cause injury, property loss or significant harm to rights. The AI and Data Processing Notice explains how information participates in model and execution workflows.
4. Files, execution and approvals
Your connected computer or selected cloud executor may read authorized files, run commands, write or delete content, access networks and call third-party services. Phones and tablets primarily initiate and manage tasks; computer operations are not necessarily performed locally on the phone. Check the execution location, working directory, tool permissions and approval mode.
Automatic execution or broader approval settings increase the operations that can proceed without individual confirmation. Approve an action only after understanding its effects. Stopping a task or withdrawing permission may not undo completed commands, requests, file changes or charges. Back up important files and use appropriate isolation.
Grant only the private values and access needed for the task. Malicious files, web pages or prompt injection may induce improper actions. Placeholders, encryption and approvals cannot guarantee prevention. You can reject unclear actions and stop a task.
5. Content, intellectual property and acceptable use
You retain rights you lawfully hold in uploaded content and work products. To provide requested features, you permit us and necessary providers to process, store, transmit and display relevant content within the required scope. Sharing and collaboration give selected recipients the access you choose. This permission does not transfer ownership to us. Personal information remains subject to the Privacy Policy and applicable law.
AI output may resemble other output. Intellectual property protection depends on applicable law. Check open-source licenses, copyright, trademarks, patents and other third-party rights involved in output. We do not promise exclusivity or automatic compliance with licensing requirements.
Our software, interface, brand and supplied materials are legally protected. You may use them as needed for normal service use, but may not unlawfully copy, sell, impersonate our brand or infringe rights. These terms do not exclude acts expressly permitted by law.
- Do not submit or generate unlawful or fraudulent content, invade privacy, infringe intellectual property, impersonate others, harass people or harm their lawful interests.
- Do not attempt unauthorized access, bypass security controls, spread malware, steal credentials, abuse computing resources or disrupt services. Authorized security research must stay within express permission.
- Do not upload institutional confidential information, others’ personal information or controlled materials without authorization. Follow applicable research ethics, export controls, sanctions and data-use rules.
- Comply with the terms of third-party services, software and datasets; do not use this service to circumvent them.
6. Allowances, fees and after-sales support
Free allowances, chargeable items, prices, units, expiration, plan entitlements and renewal conditions are governed by the information shown before a transaction and the applicable purchase channel. Models, tasks and execution resources may be charged by usage. Estimates and final usage can differ. Review cost and allowance notices and available limits before starting.
Resources already consumed may count toward usage when a task fails, stops or is canceled, subject to transaction descriptions and applicable law. Review records in available billing pages. For an issue, send an order or task identifier to business@sagaway.ai; do not send payment passwords.
Purchases, renewals, subscription management, refunds and entitlement restoration follow the transaction channel’s rules and applicable law. For purchases through Apple or another platform, use its management and support processes. This clause does not mean every client or region offers the same purchase options or that a purchase is automatically nonrefundable.
Price or entitlement changes must be communicated as required before taking effect. Undisclosed changes do not retroactively increase completed transaction fees. Before account closure, address outstanding orders and subscriptions and save needed billing records.
7. Privacy and third-party services
The Privacy Policy describes accounts, content, diagnostics, device permissions, providers and international processing. Local execution does not mean an offline AI model. Memory, files and tool output may form model context. Review model and execution notices and follow your institution’s data requirements.
Third-party websites, payment channels, models, execution devices and services you connect may have their own conditions. We explain relevant choices and scope; provider outages may affect related features. You retain the right to seek remedies from the responsible party under applicable law.
8. Changes, restrictions and termination
Networks, offline devices, model changes, maintenance and security incidents may affect availability. We do not guarantee uninterrupted service or success of every task. For significant maintenance, discontinued features or changes requiring action, we provide notice and data-saving guidance where feasible and required.
We may apply proportionate restrictions, suspension or termination to address violations, fraud, security risks, exceeded allowances or lawful authority requests. Where legally permitted and consistent with security response, we explain the reason and provide contact or appeal options. Emergency action does not remove legal notice or rights obligations.
You can stop using the service and request account closure. Information, necessary retention and outstanding transactions are handled under the Privacy Policy, transaction rules and applicable law. Affected paid entitlements are handled under applicable contracts and law; these terms do not remove refund or other duties we must fulfill.
9. Responsibility and disputes
Each party is responsible for its conduct under applicable law. We handle issues caused by service defects, breach of agreement or failure to meet our duties as required by law. These terms do not exclude liability for fraud, intentional misconduct or gross negligence, non-excludable personal injury liability or mandatory consumer protections.
To the extent permitted by law, responsibility for issues arising from unverified AI output, excessive permissions, violations of these terms or services you configure depends on the facts and applicable law. We do not deny legally required responsibility merely because output was AI-generated.
These terms are generally governed by the laws of the People’s Republic of China without depriving you of consumer or privacy rights under mandatory local laws. Contact business@sagaway.ai to seek a resolution. If a dispute remains unresolved, either party may seek relief from a competent court or authority as permitted by law.
10. Updates and contact
We may update these terms as services or laws change. We communicate material changes through the product, website or another reasonable channel and seek new acceptance where required by law. You may stop using the service before new terms take effect and contact us about existing entitlements.
